THE DEPUTY PRESIDENT: Well, Mr Ferguson, I believe you are the bearer of good tidings.

MR FERGUSON: I believe I am, your Honour. Since we were last before the commission, the union and AI Group have had some fairly productive discussions about the matter and certainly about how it might proceed and, as I understand it, the union’s view is that it does not need to proceed this morning in light of those discussions. I don’t want to take you through all of the detail of those discussions on record but would be quite happy to go off record, if that suits, to convey some of the substance of that to you.

There will be proposals, as I understand, from the union but the matter should just be adjourned generally and that is why I’d be happy to go off record to discuss some of the reason behind that. It deals in part with the fact that there is some similarity between the matters being dealt with in these proceedings and the four-yearly review and there is a view, as I understand it, that given both sets of proceedings are on foot it may be prudent to let the four-yearly review unfold firstly. As I said, we’d be quite happy to elaborate off record, your Honour.

The application has been adjourned and I propose to grant that adjournment and the matters can be relisted at short notice in light of any future events.
