Components

  1. Unfair dismissal 21-day limit

21-day time limit for job loss and dismissal applications

There is a 21-day time limit for lodging job loss and dismissal applications. This includes applications related to:

  • unfair dismissal
  • general protections dismissal
  • unfair deactivation
  • unfair termination.

You can apply or lodge online or by email when we are closed. It is very important that you get your application in before the deadline.

The 21 days begins from:

  • the day after your dismissal took effect, or
  • the day after the deactivation or termination.

If the final day of the 21-day period falls on a weekend or a public holiday, the time limit is extended to the next business day. Public holidays or weekends that fall during the 21 days will not extend the period of lodgment.

Emergency hearings outside of business hours

If you need an emergency hearing outside of business hours (for example, an application to stop unprotected industrial action), please call 0438 244 996 and leave a voice message.

This telephone number is not for questions about applications such as unfair dismissal, general protections, bullying or sexual harassment.
