In some situations, an employer may 'stand down' an employee and not pay them. This can only happen for specific reasons. If there is a dispute about the stand down, we may be able to help. Use Form F13 to ask us to deal with a stand down dispute.

Who can use this form
Only use this form if you are:
- an employee who has been, or is going to be, stood down for one of these reasons:
- industrial action
- machinery or equipment breakdown
- work has stopped for any reason your employer isn't responsible for
- an employee and have asked for leave to avoid being stood down
- a union representative
- an inspector.
Before you start
Have this information ready before you begin. You will need to tell us:
- your details
- your organisation's details (if applying on behalf of an organisation)
- your representative's details, such as a lawyer or paid agent (if you are using one)
- the details of the person or business you have the dispute with (the respondent)
- what the dispute is about
- what result you would like from this application.

You can also send or deliver your documents to the Commission office near you.
What happens next
You must send (serve) a copy of your application and any supporting documents to the respondent. You must do this as soon as possible.
