Genuine engagement and consultation
We cannot make or vary a minimum standards order or road transport contractual chain order unless there has been genuine engagement with the parties who will be covered by the order.
We must also consult with people and bodies who are likely to be affected before we
- make or vary a minimum standards order or
- make or vary a road transport contractual chain order.
As part of the consultation process we will publish on our website
- a notice of intent which states that we propose to make a minimum standards order or a road transport contractual chain order, and
- a draft of the proposed order.
We will provide an opportunity for affected people or bodies to make submissions on the draft order. These submissions will usually be published on our website. We may decide not to publish confidential or commercially sensitive information.
We may hold a hearing to discuss the draft order.
After the consultation process is complete, we will decide whether to make the order. We may also make changes to the draft order.
Consultation process if we change a draft order
If we make significant changes to the draft order, we must start a new consultation process. We will publish a new notice of intent and the draft order on our website.
For employee-like minimum standards orders, we will allow a reasonable time for further consultation, considering the nature of digital platform work.
For road transport minimum standards orders and road transport contractual chain orders, we must generally allow at least 12 months after we publish the new notice of intent before any order can take effect. We may reduce this to 6 months if the circumstances are urgent.
The Road Transport Advisory Group
We must consult the Road Transport Advisory Group (RTAG) before we can make or vary a road transport minimum standards order or road transport contractual chain order, or before we vary or revoke a deferred road transport minimum standards order or road transport contractual chain order.
