On 26 March 2021 Mr Grahame Kelly made an application under section 94 of the Fair Work (Registered Organisations) Act 2009 for a ballot to be held to decide whether the Mining and Energy Division (ME Division) should withdraw from the Construction, Forestry, Maritime, Mining and Energy Union (CFMMEU).
