Restrictions apply to ‘removed persons’ unless we have granted them a certificate.

Certain people who have been removed or suspended from their role as an officer, employee or workplace delegate as a result of the scheme for administration of the CFMEU Construction and General Division are restricted from:
- becoming a candidate for election for or being appointed to an office in any organisation
- becoming employed or engaged by any organisation, and
- being, purporting to be or holding themselves out to be a bargaining representative for an employee or an employer,
unless we have granted them a certificate.
These restrictions also apply to certain people who, by choice, stopped being:
- an officer of the CFMEU Construction and General Division
- a CFMEU employee working in the Construction and General Division, or
- a workplace delegate for members of the CFMEU Construction and General Division
between 1 July 2024 and when the administration took effect on 23 August 2024, if the administrator has decided that the person would have stopped being an officer, employee or workplace delegate under the scheme.
