These steps show how we process applications for a Fair Work entry permit.
We aim to issue entry permits within 4 weeks of receiving the application.
Help with the process
We can give you information to help you know what usually happens at each step, and how long it might take. You can email us at [email protected] if you have questions.
We can give you information about our processes, but we can't give you legal advice.
Step 1: The union lodges:
- Form F42 – Application for an entry permit or
- Form F42D – application to renew a current entry permit.
Step 2: For Form F42 applications only, we will email the proposed permit holder an invitation to an online ID verification meeting. At the meeting, the proposed permit holder will need to show their current driver’s licence, passport or ImmiCard, so we can verify their identity. The meeting will be recorded.
Step 3: We complete our assessment of whether the proposed permit holder is a fit and proper person to hold an entry permit.
Step 4: If the proposed permit holder is a fit and proper person, we issue the entry permit and post it to the address provided on the application form.
Fair Work entry permit processing time
It takes us about 4 weeks to process an application for an entry permit.
Section 516(2) of the Fair Work Act 2009 allows for an existing permit to be extended while the renewing application is being assessed. The union can apply for an extension but it must be lodged at least 4 weeks before the current permit expires.
If the union believes the application for a new permit may be delayed due to permit qualification matters, it can apply for an extension under section 516(2).
Avoid delays to your Fair Work entry permit
It takes longer to process an application if we need to contact you for more information.
The union should make sure:
- all the information in the application form is correct
- both declarations are true and correct, and have been signed and dated
- the committee of management member has made proper enquiries about the proposed permit holder being a fit and proper person to hold an entry permit
- for Form F42 applications, that:
- a full-face recent passport-sized photo of the permit holder is attached, and
- evidence of completed entry permit training is attached.
