Two applications for an Equal Remuneration Order were made in 2013. An application for a variation to the Educational Services (Teachers) Award 2010 was made in 2018. These applications were dealt with by a Full Bench of the Fair Work Commission.
Introduction
On 15 July 2013, United Voice and the Australian Education Union (Victorian Branch) lodged an application for an Equal Remuneration Order.
The Independent Education Union of Australia lodged an additional application for an Equal Remuneration Order on 8 October 2013.
A further application was lodged by the IEU on 17 August 2018 to change the Educational Services (Teachers) Award 2010 under section 158 of the Fair Work Act 2009 on work value grounds.
These applications were dealt with by a Full Bench of the Fair Work Commission.
On 6 February 2018, the Full Bench dismissed the AEU and United Voice applications for equal remuneration orders (see [2018] FWCFB 177).
On 19 April 2021, the Full Bench dismissed the IEU’s application for an equal remuneration order (see [2021] FWCFB 2051). In this case, the Full Bench held that it was satisfied that an adjustment of the minimum rates of teachers covered by the Educational Services (Teachers) Award 2010 was justified by work value reasons. A determination was issued with the decision, operative January 2022.
