The Commission is considering three applications before an Expert Panel for the Care and Community Sector to vary the sleepover arrangements in the Social, Community, Home Care and Disability Services Industry Award 2010.
The Commission has determined to join these proceedings together where the applications relate to sleepover arrangements such that they will be heard concurrently.

AM2023/28 | In November 2023, the Australian Industry Group (Ai Group) made an application undersection 160or, in the alternative, undersection 158of the Fair Work Act 2009. It seeks to vary the sleepover arrangements in the Award to clarify their operation. |
AM2024/16 | In March 2024, Parkerville Children and Youth Care Incorporated made an application undersection 160(1), or in the alternative, undersection 157(1)of the Fair Work Act 2009. It seeks to remove ambiguity and/or uncertainty with respect to coverage of Therapeutic Carers, sleepover arrangements and/or 24-hour care arrangements in the Award. Some variations sought in this application have already been made (see [2024] FWCFB 385). The remaining variations sought in the application are currently being heard by the Commission. |
AM2024/30 | In July 2024, the Australian Services Union and others made an application under section 157of the Fair Work Act 2009. It seeks to vary clauses 25.4, 25.7 and 28 of the Award, which refer to rest breaks between work, sleepovers and overtime and penalty rates respectively. |
